Custody without Child Support order

State of TX. I posted yesterday but do not see it listed. Hope I'm not duplicating. My step-daughter got a divorce in 1997 and did not file for child support stating she did not want the father to see his child. Will this keep him from seeing his child?

2nd question: We as grandparents are filing for custody of this child as both parents are in prison. Can we file for back child support in conjuction with current child support going back to 1997?

NO. Child support and visitation/custody are not the same thing.

Who are you going to ask for back child support? You can try but I sincerely doubt you will see anything, even when they get out of jail.

We will probably file for child support from the father. We know we will probably never see a dime but if we do we want to put it in a savings account for the boy. Is paying child support a condition of probation or parole? Thank you for your help.
