I have been denied the right of seeing my son on my court order visitation weekend. My sons father has custody but only because they failed to summons me to court so the judge awarded him all rights.I have an attorney trying to have that set aside. But my questions is that my attorney can't answer is what can i do about being denied the right to pick my son up on my visitation weekend?I called the local police dept. to come to my ex's house and all they did was file a report stating my sons daddy wouldn't let me have him and it was my weekend. He also refused child support.I was told to go issue a contempt warrant but my attorney has never heard of such thing. What can i do? I haven't seen my son in a month. What do i need to get done about this matter.I live in Georgia.

OMG Poop on the peach state........ First of all if you have court ordered visitaion rights then he's in Contempt. If lawyer has never heard of it how did he pass the bar exam. Thier are contempt laws of some kind in every state. Ok....... here is my advice. Get on the horn ( phone ) and contact lawyers and ask for a free consultaion. Do this until you find a lawyer that you like what they say, then hire that lawyer. I'll pray for you...... I know what it's like to be kept from your children. ( My stepson's mother is keeping him from me for no reason :( )

Maybe there is some miscommunication. It's not a contempt warrent. You have to file a contempt of court petition thing. But it's not a warrent. Maybe that's why he's confused. He's in contempt of court because he's refusing to comply with a court order. Can't you get a temp. custody order because of this? I'm not sure but I thought I heard you can. All I can say is it's not going to look good on him at all. But maybe you should try the sherriff and see if they will escort you and take the court order with you.
