Have emergency custody order/restraining papers in Texas. Are we able to tell the other parent there are in fact orders in place if they haven't been served yet, if they are threatening?

Of course you can. However, hopefully you got those emergency orders in the proper jurisdiction.

Who is we? The other side cannot be accused of violating the orders until they are served them.
