My ex who has custody of the two boys 8&5, lives with her parents and they all smoke in the house. One is a chain smoker who is home all day. the kids are always sick and have a constant cough- over 2years. i can't convince them to stop and their doctor won't say definitively that its the cause of their illnesses. The lawyers say sue for custody- but he chances aare slim. Are there any alternatives that anyone knows of?

My husband requested that there will be no smoking allowed around his daughter. i.e.
In the house and car.
The judge granted it. Its in the court papers.

Proving that bio mom smokes in the car with daughter in the car is another story.

My response:

There is no case law that definitively states that second-hand smoke is the cause of illness that requires a custody change. There are only "studies" on both sides of the fence. So, if you want to spend the money on expert witnesses to prove the effects of second-hand smoke, then you'll be doing a lot better than the governmental hearings on the subject.
