In California (you know, my home state), breastfeeding is not going to constitute an emergency, and the fact baby is already being acclimated to formula just serves to seal the deal.
This is one reason why I see a TRO that will prevent dad from being around the child is unlikely. I still believe that an emergency ex parte hearing is a possibility, but, the circumstances may not warrant it in the minds of the court.
