FL Child Custody Laws for Grandparent with Custody.

What is the name of your state? Florida

We would like to know what right we have as custodial Grandparents with custody (Temporary Custody) pertaining to visitation by the parents. We are trying to give the children a stable environment and a loving one but the two parents just care about themselves, especially the mother. The mother is an Alcoholic, who is still married to the children’s father and has had at least eight different lovers in the last year and a half. She wants to take the children (age’s girl 5, girl 6, and boy 8) to her current lover’s house to meet him and his parents.

We have had and still do have an open door policy. We told her no! She can come to our house any time she likes to see the children, but has only come by twice in three months to the dismay of her children :( .

It should be noted that this women has left the family on at least three occasions and disappeared for weeks to visit boyfriends out of state when she lived with her children and husband. She is Bi-polar :eek: , manic depressive :confused: , suicidal :eek: , alcoholic, and allegedly using cocaine :cool: . She supposedly tested positive according to her husband when she was baker acted once at the Mental Health facility.

To prevent a long and bitter fight, she willingly signed over custody to my wife and I, the Grandparents of the two girls. The boy is our son's step son and she signed over custody and the courts granted custody of him to us too. All three are Temporary Custody from Family Court.

What are our rights under Florida Law to regulate visitation by the non custodial parents. Especially, our rights against a mother who is unfit and her own family (except her mother, who is like her) would testify in court to prevent her from getting the children. They know the children's safety and wellbeing would be in jeopardy.

She tried to commit suicide in front of them once! :eek:

What we need to know is what are our legal rights to establish visitation and what law establishes this right. What do we need to do to strengthen our rights and stabilize our rights to protect the children? We think about the children. They think about themselves and how they can show case the children. Once this is done then they look for someone to hand them off to.

If you have temp. custody, then you know the court system well enough to ask your lawyer, your story is to complicated to give an accurate legal view.

Where is your son, and why are you not trashing him for not having custody?
