What is the name of your state (only U.S. law)? Michigan

My husband and I have been married for 11 yrs now and the past year or so we have grown apart. I have tried to remain in our home for as long as possible but he is getting worse. I have contacted several attornies and I have one that I want to hire but can not afford the retainer fee. My husband owns his own company and has not worked in over a month now and I am paying all the bills. Recently he has become more and more abusive toward me, not towards our daughter, and there has been serveral incidents where I have taken my daughter and fled our home. On weekends sometimes my daughter visits with her grandparents and when she does I stay in hotels so I am not alone with my husband because I fear what he may try to do. It has gotten to the point where I can no longer live in the same home as him and the other day I had surgery and needed to get my things, he refused to let me enter the home and told me that "loved ones are going to start to disapper". He knows I have gotten an apartment and I am moving in next week and I am off work this week due to my surgery. I had to go to the local police station to escort me into my home to get some of my clothes and to see my daughter - they would not let me take her to my parents home with me because he would not agree to it and there is no type of custody arrangement at the moment. Later on that evening he did allow her to come over and stay the night but the next morning he started threatening me again and came over and got our daughter. I am filing a PPO (Personal Protection Order) against him for the physcial abuse and death threats but I found out thru a friend that he is filing an injunction against me which will prevent me from taking my daughter (we agreed that when I get my apartment we would follow the joint custody format as stated by the courts) on my days & weekends. How do I get custody of my daughter or even get to see her until I can afford an attorney?

He cannot file an injunction against you. He can file for temporary custody, but so can you.

Is your child in school? Pick her up from school today (a little early would be best) and then this time don't give her to dad when he comes storming over. File for the PPO and for temporary custody ASAP.

sorry hun

i know what it feels like and all you can do is get her under your wing and not let her go, file the ppo and then for custody in that time, just go to the court, and do not forget copies of police reports. i lost my kids that way i was to young to understand, now i am struggling to get them back. much luck.
