Hi I am a father who is seeking what are the possibilities of me getting overnight stay with my son. He is currently 2 years old. Me and the mom are up and down. We went to court in when he was around 6 months old and the court granted me monday wednseday, friday and every other sunday for only 3 hours. After court happened she wanted to work things out so i was getting him more than what court granted me thank god. she even insisted at the age of two he would be able to spend the night at my house. Well unfortunately that didn't happen. He is two now and we are at each others throats getting in arguements and everything, and now she wants to go by court ruling monday wednesday and friday and every other sunday for 3 hours even though that rulling happened when he was 6 months old.

I am no dead beat dad. I work full time. I go to school. I pay my child support. I get guaranteed weekends off. all i asked from her was a little more time and freedom with me and my son. An overnight stay would be amazing, so i am asking anyone should i bring her back to court and would i get more time and possible overnight stay. and its not like i live 100 miles away from her house i literally live around 2 miles away 4-6 minute drive.

I would say the age factor may be a significant change of circumstances .

Since you have weekends off , I see no reason a modification with more hrs. on the weekends and over nights wouldn't work.

You could request some standard visitatations . Every other weekend , alternate holidays ( if you get some off tell the court which ones ) , 2- 3 weeks summer vacation , Christmas day or eve., maybe some school holidays if you are not working . Think what might work for you and present it for modification.

Shockingly for a Saturday night, I agree with BL.

There's absolutely no reason you shouldn't have more time with your son. Figure out the minor details if they're not already ironed out (who picks up, all that stuff) and go for it.

Shockingly , I'm am feeling a bit better after a month and a 1/2 of being sickened. Drs. ENT yesterday-still a nasty sinus infection - said good news you throat masses are gone., specialist , have a pulmo Mon. to figure out this non stop cough. Steroids keeping me up, Oh it's Sunday BTW . :) Yeh was weaker n He W L had to hang on stuff to walk around the house , abulance to get me from gasping for air, but better now ..

Always nice to spend more time with children ...Back to subject.

I feel i should go back to court and get more hours and perhaps overnights. since he is two years now.

Just keep in mind dad that you are probably not going to get Monday, Wednesday and every other weekend overnight. That is too rough of a schedule for a child, and too dramatic of a change for a two year old. The overnights will probably be only be the every other weekend, some holidays and some extended summer time. Mom will also get some extended summer time as well.

We were in a relationship and things just fell apart, so I just realized that its not going to work out for us and just best to move on, but try our best to be civil with for our son.

You would at least get one three or four hour period on a weekday.

You can ask for EOW - you can try for Friday night through Monday morning with you responsible for getting child to daycare/ school. Ask for at least one evening, if not an overnight during the week when you won't have the weekend.

Each party should be granted an uninterrupted period of vacation with it alternating by year who gets first priority. That uninterrupted period should not include the other parent's holiday. If you go by week, it needs to be a one week period that includes your weekend so that neither party takes away the weekends from the other parent.

Stipulate your holidays.

Think long term and how to handle school if you are going to court now.

How have you addressed transportation? If not addressed, it should be. Many times, it is split with the receiving party getting the child (see comment above on exception.)

Think virtual parenting time (phone, skype, emails, etc.) How often do you want YOUR parenting time interrupted by the other parent and use that as a guideline to asking for same on mom's time.

Thank you Tinker I will defintely request EOW. It doesn't hurt one bit. That is what I am truly hoping for if it does work out is to at least get 1 day of overnight. My child is two years old and has not once slept over my house. It's a horrible feeling, but I have to be strong and hope for the best.


Now i have a swimming pool in the backyard (inground) with no fence. Would that prevent me from having my child spend the night? Would I have to get a fence or would a pool alarm which we have throughout the house (all windows and doors)?

Forget the night - I'd be worried about having a child there during the day. Maybe this is just the former lifeguard in me, but why don't you fix this before going to court asking for overnights? Expensive, yes. But could you live with yourself if a child opened the back door and somehow ended up in that pool? It takes so little time for a tyke to slip through a door that's been left ajar...

Don't most areas mandate a fence these days?

Dad, if it were me, I'd be screaming bloody murder until you got that fence. I know there's never a 100% guarantee of a child's safety, but this is an easy (if expensive) fix.

Do it for the child.
