How to get custody?


What is the name of your state? Middletown, NY



My best friend is in a domestic violence relationship and she finally left him two weeks ago. The father of her child is the guy she was staying with. He is a drug user and he also drinks a lot as well and doesn’t care about the child or her. He doesn’t work and he has a history of being in and out of jail.

What is the procedure for her to get full custody of her child? Also what forms does she need to have in order to get this whole thing in motion? She has no money called to her name and she is currently living with her mother for a short period of time so I don’t think a lawyer is something she would be able to afford. So how would she protect her son and get custody without the expensive lawyers?

If she wants to do it herself then she can get the forms at the self support center. I don't recomend it though.

Were they married? Has paternity been established?

No they are not married. I don't think any paternity has been established either.

Is there any way she can get free legal help because of her being abused? Not sure how it goes there..but here in Texas I was being abused by my ex but he hadnt been sent to jail for it. and they took my case and all I had to pay was 165 dollars....just something to look in too.

If she was living with dad when the child was born there is a reasonable probabilty that paternity was established.
