irresponsible father and vistation

State of residence is CA. Father and Mother were never married. Mother has sole physical custody and joint legal custody since Dec 1997. Since that time father RARELY contacts the children but every 6 months or so. he doesnt work and therefore provides NO financial support to the children. He doesn't seem them every other weekend and on holidays as the court gave vistation to him. He took them for Thanksgiving for the weekend and was to return them by 6 pm on that Sunday. He kept one of the children for a week and refused to bring him home. The child was kept out of school for a week by the father who said he would not return the child until the mother promised to sign a paper giving him custody. Naturally the mother did not agree and finally filed a report with the local police department and that is the only reason why he brought the boy home (after filing a false child abuse claim against the mother.) He brought the boy home at midnight. He has been calling the boy (he has nothing to do with the girl) at late hours of the night to talk to him (after the child is in bed.)He keeps calling the boy and hounding him about coming to live with him. It is tearing the boy apart and making him feel guilty for wanting to live with mother. I think he only wants the kid for state aid and no other reason. The father is disrupting the household and causing great stress to all involved. Can the mother go back to court and modify the vistation rights from non monitored to monitored vistation at the local police station? The father is very unreliable and never brings them home on time. Any suggestions ?Btw.. the reason the court order for custody was initiated 3 yrs ago is because the father took the kids at thanksgiving and refused to return them. He took off with them and did not return them until mother filed for custody. He comes in and out the kids life every 4-6 months or so and only when it is convenient for him. any suggestions ?

First of all, the phone calls at midnight would not be happening, have the recorder pick it up with the date and time stamp and let him leave messages. Then take that to court to show the judge the father is losing his frickin mind.

Sorry, had to vent a little..

Second of all she needs to petition the court for modification of the visitation. Since he has a history of not returning the child(ren) that should be sufficient evidence to either get his visitations revoked or supervised. While she is at it she can petition for an increase in Child Support. I would sock it too him, literally.. if he wants to play dumbass, then play his game right back.. the legaal way.
