joint custody/trying 2 move 24miles but out of state

What is the name of your state? IL. I have joint custody of my daughter ,with myself being primary resident. joint parenting agreement saying i must live within 75miles of father , but it does not say anything about same state. i'm trying to move out of state 24miles to Indiana. and i told my ex that i will still let him take her 2 to 3 times a week . He is threatening to take me back to court to fight for custody. does he have a case?:(

Yes, he sure does. Unless you petition the court for permission to remove the child from the jurisdiction.

The fastest way to do this is to tell the ex that you would file a joint petition with the court for the move and stipulate that you agree that jurisdiction remain with Illinois until such time as the ex moves or relocates away from Illinois.
