Update


okey dokey.

so we had court this morning.

11 year old will be moving back with his father. father will be transfering school records. visitation has flipped back to alternate weekends. i still retain custody of the 7 year old.

so 11 year old gets rewarded. nice. dad will not be punishing child for the money he stole from me nor will he be punishing the child for money he stole from his father, which was $45.00.

minor's attorney says my rules were too rigid and son does not have any freedom. i understand where the attorney is coming from, but i do not agree.

father says his girlfriend works for the unified school district, which means nothing really, she could be a janitor for all i know. he is having girlfriend move in probably in Jan. judge told him to NOT have her move-in. focus needs to be on the child. father wants child to be bussed to a different district. not his own.

hmm, i should have had an attorney. dad had NO intention on co-parenting with me. it was used against me.

thank you, LD and babygirl.

i'm coping, sort of. i'm trying to figure out how to not wallow. but for now, i will just have to be pro-active about his schooling same as when i didn't have custody. i should have been more active on showing dad was not helping the child with his homework, when dad wasn't making sure weekend assignments were turned in, i should have filed contempt of court when dad wasn't taking the child to his court ordered tutoring. and i didn't. so i failed.

so step one, make sure son gets enrolled in the proper school. i will be objecting to child being bussed to a different school out of dad's district. (dad wants child in his girlfriend's school) i will be doing weekly reports with all teachers to monitor test grades, homework completion and correction. basicly all i have been doing as of late, just from a distance. so i wll be charging up gas all over again. bummer.

Issabella...I am so sorry...Just continue to be the GREAT mother you are and hopefully everything will work out in the end.

I was INCREDIBLY impressed with how you handled the theft situation...including how you called Dad. That he acted like a POS does not distract from the fact you did the RIGHT thing in trying to clue him in to your child's crime.

on a bright note, the judge and the minor's attorney thanked me for not giving either of them a hard time about granting custody to dad.

I'm sorry Isabella. Yes, bad ruling.

I'm sure that your adherence to solid principles is not and will not be lost on your son. For eleven years they have been clear to him, and you seem like the kind of person who will continue to live by them, all of which is and has been a great service to him.

so, i just found out today that father of my two older boy's license has been suspended. nice.

now, technically, i don't have proof, like a DMV report. what i do have is a OSC to release driver's license. now, i plan on calling the CSSD first thing in the morning to see if they will tell me how long his license has been suspended. or at least when the report to the DMV from CSSD went out.

now, since i haven't known about the license being suspended, dad has been picking up the children on his visitation days as usual. by himself. not once have i ever seen a passenger. always him in the driver seat.

now, i'm getting the paperwork ready, minus dates and times tonight. i fully plan on heading to court first thing tomorrow for contempt as it is in the court order that all drivers must have valid license and insurance.

now, i'm trying to figure out. how to do this without involving the kids. should i take 7 year old out a few minutes early, call dad to pick him up at my house, stall dad outside, call the police, then deny dad if he is alone?

You have my total sympathy. My son is fighting like mad to keep custody of his kids. Know right where you are.

Maybe your ex will be begging you to take your son back when he starts finding out that his wallet starts missing its contents, his charge cards have been maxed out, and he has bills coming in that he never heard of. Probably will lose the novelty of parenting really soon if he can't have his girlfriend move in. An eleven year old will certainly curtail his social activities in this regard.

Hopefully your ex will see soon that he made a mistake and got what he asked for, not knowing it wasn't what he really wanted.

But believe me, you NEVER want to court into court without representation yourself! And get a lawyer you can trust. Nothing is worse than to have one that seems to be working more against you than for you. Been there, done that. Fired him, got a great one.

Hats off to you for the courage to go to school and confront the kid to begin with! I wouldn't have done that. Would have waited for them to come home and then gone after them. Your ex must be an idiot! But then, he is your ex for a reason!

I really am not sure at all what to advise you. My gut reaction is that you should inform dad ahead of time that you know about the suspension and that you won't allow him to pick up the child unless there is a licensed driver with him.

Then do the above if he shows up alone.
