Leaving the U.S. with newborn, without father

What is the name of your state? NY
Because of financial problems I might have to leave the U.S. with my newborn baby soon. We would go to my home country Germany. Neither I am american nor I have any legal documentation. The father of my child who's my boy-friend would stay here for now and support our plan. The question is: what do I need when leaving the U.S. for Germany? Will it be difficult to cross the border in my situation?

When you have your baby, your boyfriend can sign the acknowledgement of paternity. With his permission you may apply for a passport for the child. You may not leave the country with the child without the father's permission. You already know that cannot reenter the USA for 10 years since you overstayed your visa he could change his mind. If you are deported, the baby stays here.

That may not be accurate. She certainly can't get a US passport for the baby without the father's agreement and signature. However, since she isn't a legal resident of the US, and the baby would be entitled to German citizenship, then German laws would apply regarding getting the baby a German passport. Those laws may not be the same as US law.
