My husband is in the military. we are curently stationed in colorado. while his daughter was visiting here for spring break we learned lots of information... my step daughter told us that if she gives out information her mother spanks her... also if the mother gets mad the mother shakes her daughter (shes 8) the child shares a room with four other children 1 being a boy and my stepdaughter has already showed sexual behavior in yhe past. also my step daughter said the aunt with whom they live slapped her because the child did not put away things to the aunts likeing.. lastly the child still had a temporary filling in her tooth from last year when we had the child also there was still decay in another tooth known issues from last april.
1. is this enough to will cutody?
2.will his military status be a factor?
3. would us being married in a 2 bedroom with only ourselves and my 6 month old son show us to be stable enough??

thats how we found out the tempoary filling was still in 1 year later but the other tooth still needs to be taken care of cause she needs to she a specialist

Spanking is an allowable punishment. Different rules for different households. And apparently stepdaughter is not afraid of this because she gives out information to you freely enough.

Shakes her daughter how? And prove it causes the child harm.

Not illegal if mom approved of aunt disciplining her.

Kids get cavities. It happens.

You cannot WILL custody. Doesn't work. Kids are not property. As for changing custody -- nope. What you have expressed is not enough to change custody.

Is he deployable? When was he last in Iraq? Is he due to leave the country? Is he due to be transferred anytime in the future?

That doesn't show stability nor has anything you have said show mom to be unstable.

If you brought these accusations in front of a Judge, The child isn't going to be the only one getting spanked. An 8 year old is not just going to randomly share information about mom if she fears being punished for it. So, either you and dad are interrogating her (which is a HUGE no-no) or she is lying.
