Does the fact that marriage never occurred affect custody?

I am a stepfather with the mother since early in her pregnancy and we have raised a little girl for 2 1/2 years together. The ex-boyfriend (biologic father) has had regular visits 3x/wk, but now wants a split living visitation agreement. Is this likely to be granted? I can see how a psychologist might try to mitigate separation pain for a child of a marriage that splits, but this little girl has always had a stable home and family with us. Is it in her best interest to now grant a split living situation?
