What is the name of your state (only U.S. law)? Texas
Mom is in jail for theft, possession of marijuana, driving with a suspended license, etc. Can father get full /temporary custody of children? What does dad need to do?What is the name of your state (only U.S. law)?

Dad can ask for emergency, temporary physical custody, assuming that the answers to CC's questions are that mom is going to be in jail for a while, and dad has a current relationship with the children.

However if mom was arrested today, and bails out or is released on her own recognizance within a couple of days, then its best to wait and see what happens with mom's criminal case. The "emergency" will be gone if mom is released.

Unless of course the kids were in the car with mom when she was arrested....that's a whole 'nuther story.
