my son has 1-yr old daughter with girl that suddenly died friday. my son is serving a two-year sentence in prison. as the child's only lliving parent does he have any rights regarding custody?

Unless his rights have been revoked, he still is the childs biological parent and has those rights. What 'rights' were you specifically referring to??? Presumably, you are asking about temporary custody, correct?? If so, that will be decided by the CPS office.
