    Necessity of awarding "primary residence" when parents have joint custody

    What is the name of your state (only U.S. law)? Maine
    Is it mandatory, in Maine, to award primary residence to one parent in cases where parental rights and responsibilities are generally shared? What are the possible implications of one parent being awarded primary residence? Does the designation of primary residence imply any inherent legal advantage? Thank you.

    In general if it is a true 50-50, awarding primary residence as a designation does not really pose any advantage.

    In many states, a primary residence designation is necessary for school purposes and things like that. A person need one "legal" address. Other than that, if the time is a true 50/50, there is no advantage.

    If the timeshare is not a true 50/50, then the parent with whom the child spends the most time, is going to be the one with primary residence.
