What is the law regarding you have had a child but never did marry?
Can the father get custody?
Circumstances: The mother has went back and forth with 2 guys. After she had the baby she wanted the one guy back which is the father of the child. They got back together when the baby was 3 weeks old. They moved in with the father. he has provided the home. The mother started messing around with the other guy again. So the father kicked the mother out but continued to have the baby overnight because the mother worked 3-11:00 p.m. Months went by the mother wanted the father back again, he took her back. This has happened a few times. This last time she moved out again. Now she has changed shifts and the father hardly gets to see the baby. The baby is now 1 year and 2 months old. He got really attached to the father. Now the father wants to take the mother to court and get full custody or joint physical custody. The mother is not the greatest mother. Everything has always been documented about the mother not being a great mother and the times which the baby was with the mother and the times which the baby was with the father. The father has had the baby pretty much most of the time. Now waht do you think?

get a dna test first

i would strongly suggest you have a paternityy test done to make sure the child is yours,then when it comes back you are the father,then file for custody/visitation.untill then.you have no rights to the child.
