What is the name of your state (only U.S. law)? New Mexico
After a short relationship, I ended up pregnant. The sperm donor n I parted ways when I was just 2 mos. pregnant +/- and he did attend the first 2 Dr appts., and then started making excuses to not attend anymore. When he found out I had another boyfriend, he called threatening me with a gun. My family tried to keep him updated, but kept me out of having to speak to him cuz of the threats. Then one appt, at approx 6 months +/-, I had showed signs that things might be terribly wrong with the baby's growth, so my family told him of the emergency ultrasound happening that next day and he said he would show. He didnt. From that point on I told my family, no more updates and no telling him when I give birth. While in the hospital, after birth, he found out through the grapevine and he and his mom and sister barged into the hospital and had to be escorted out by security. I did not list a father on the birth certificate and my child has my last name. I hear that they are obtaining a lawyer now, do I stand a chance? Do they? There are no issues on my part of caring for the baby's well being, financially or otherwise. I have no illegal records, etc. He was just in jail a few months ago (just before the baby came) for auto theft, possession of burglary tools, evading arrest, etc. His mom even has 23 violations to include drug distribution, shoplifting, DUI's, etc. They have gang affiliation as well. And mutual friends tell us he is now selling drugs. I do worry that the baby will be less cared for and even unsafe in those types of practices, but I hear that a persons record doesnt count in custody...Does it?
