Secondary residential parent was ordered by the court to give a minimum 3 day notice to have visitation.
Primary residential parent when taken back to court for contempt charges had this put into order as they said they felt that secondary residential parent was not respecting the primary reseidential time with the children. Primary stated that secondary residential parent waited till last minute and would show up demanding their visitation.
At any rate it was put in an order that Secondary parent is required to send proper notification return receipt requested. Secondary parent was in area and asked that morning to have kids....primary parent said no that since they didnt here from them that they aleady had plans for the kids. Can they do that?

Jaysus Christ on Aluminum Crutches. Can't you put that in just plain old English without the secondary residential parent and primary residential parent silliness?
 
sorry.....

the father is denying the mother visiation saying she didnt give her reqired notice. Mom showed up in town and feels like since she drove 6 hours and was in town she should have the kids. Dad said no, and says that he just got them back a few days ago from them being with her for 6 weeks.
Basically he is ticked off that she is just showing up and demanding time with the kids.

Well, duh. The court said she can't do that, but has to provide a minimum of 3 days notice via USMail, RRR. If she didn't do that, she's sh*t out of luck.
 
ok....dont want to make anyone mad....but she did drive all that way to meet the kids school teachers....just seems heartless.....especially when he was the one who moved with the kids....yes, he was granted permission to relocate.
but an order is an order I guess. She was hoping to show a pattern of him being uncooperative and reverse custody. Problem is that he doesn't deny her visiation....he just won't budge one inch with giving more time.

And he is under no obligation to do so. He is following the court order, and it would be wise for Mom to do the same.

So Mom decided on the spur of the moment to go to their town and visit with the teachers? Why do I find this difficult to believe?
 
Yea....she can be a bit impulsive. She said she actually told him a few days out...maybe this is the reason he is the primary parent.

And it sounds as though she's pulled this sort of thing before - hence the order requiring the written notification w/3 days notice.
