The only "right of first refusal" I am familiar with is in regard to child care. If you as the CP need a sitter, you must first ask the NCP if they want to keep the child. If they decline, then you are free to engage another party to sit with the child. Thus, they have right of first refusal about keeping the child during the period in which they need outside care.
