What is the name of your state (only U.S. law)? CA
Hello,
My friend had a child due to an affair before breaking from marriage legally. Due to circumstances she have to give her husband name as father name for the kid even though he is not the one.
The relationship with her lover has taken an ugly turn so she wants to continue her relationship with her husband. Now her lover wants to claim the child legally through DNA test, if she refuses to allow him visit the child.
Points to note:
1) All of them involved are from India and the mother,child now stays in US and hold a greencard.
2) Husband visa processing is not done yet, he is still in India.
3) Lover is also in India. Married another girl and settled in India.
Questions:
1) Will the fathers name of the child could be changed now, Kid is 5.5 years old and born in India?
2) The mother of the kid was forced to provide the false information during the child birth since no one was there to support her otherwise, does this act lead to any punishment? if so what could be it?
