Should I seek Joint Custody or Sole Custody

I have temproary joint custody of my daughter until August 27th which will be my court date. My daughter is 14 and she lived with her mother for the past 12 years. I have been paying child support all this time and current. During those years. my ex was accussed of child neglect. My daughter was taken away from her by CPS at the age of 4. My ex has a CPS record. I took custody of my daughter for one month during that time and return her back to her because at the time I was unemployed and she hired a good attorney to get her back. At the age of 10 my ex moved away to New Mexico which made it difficult to see my daughter. She lived in small town in the mountains. Last year my ex married a man of Indian decent and moved to Houston. The man is in his late 40's. The man attempted to groom my daughter in having sex with her. I reported it to CPS; however, CPS drop the case because there was no skin to skin contact. I discovered this was going on due to my daughter having conversations with a friend of her aunt. Sexully grooming included showing indian pornography and touching. Pressing his private parts against her body while clothed. My ex is now saying that it was a mistake and that in India this is customery for a father to sexually groom her daughter or step daughter to prepare her for marriage and that her husband is now in India which is no threat to my daughter. CPS gave her a temporary order where she cannot leave my daughter unsupervised. She is careless and I feel she will forget. My ex recently barged into my house and starting taking pictures while I was on the phone since I work out of the home when she came to pick up my daughter because she has her Wednesdays. I am affraid she is setting me up. My daughter made the decision to live with me and told her Ad Litem that she wants to live with me. Since my ex had her for such a long time, I am afraid that the court will not allow me to take full custody. I do not wish to deprive my wife of seeing my daughter; however, I am concerned for the safety of my daughter. The attorney are drawing up joint custody papers. My question is should I ask my attorney to seek full custody or joint custody. In Texas I know the courts prefer joint custody.

just an opinion.. Joint Managing Conservatorship is undefined in TX. JMC is the standard but it leaves way for several different scenarios. You can be awarded JMC and still have all exclusive legal rights.. exclusive decision making for primary residence, education, pschycological.. extra provisions can be added or left out of the standard visitation orders..much depends on your attorney seeking what you feel is in the best interest of the child and showing cause should your ex not be agreeable to the terms you are seeking.
