I am never married, and my son does not have a relationship with his father. Can a member of my family obtain custody if I die before he reaches age 18, or would his father automatically get custody?

Since Dad does apparently pay support, he is legally considered as having a relationship with his son. I'd expect that he would stand a good chance for gaining custody in the event of your demise, barring some reason why he wouldn't be fit. Why doesn't he have a closer relationship with the boy?

Barring a finding of unfitness from the court, which would have to be initiated by a party other than your ex or someone with standing, your child's father WILL get custody. He's the father. Regardless of how you feel.
