What is the name of your state? Texas. First time user... Have a legal question regarding my stepchildren. The ex filed all papers in Phoenix, after five years we found out she was using drugs hopping around from different houses, drinking, just an unsafe enviroment. Long story short we filed a temporary order went to Phoenix did everything ourselves and were awarded custody July 1st. 2003. Remember was Temporary emergency order . We came back to Texas and the children now live here for over three years. I want to know since they have been living here can we file new paperwork for permanent custody to include child support here in Texas or do we have to go back to Phoenix?

You can file and ask that Az. give up jurisdiction to Texas. If the child has been there for 3 years they just might go for it. Never hurts to ask though.
