Maybe.

What were the circumstances of the recording and where was it?

In general (although there are exceptions), if you have no expectation of privacy, then it's OK to record. For example, it's typically OK to record someone who is standing on the sidewalk in front of their house.

But fill in the details and maybe someone can be more specific.
