Visitation question (dad is sex offender)

What is the name of your state? New York

My daughter's grandma has one saturday nite visit per month (her father's mother). She doesnt always get to see her everymonth. And we have tried to get along for my daughter's sake. So i sometimes allow her to keep her 2 nites at a time instead of just 1. The problem is she has been asking me to let her take my daughter to see her father who is in federal prison in pennsylvania. He has been locked up since before the baby was born. her bday is 11/2001. He is a sex offender.

I told her i didnt think that was a good idea. She said to me , well if he was in NY state i wouldnt even have to ask you. I asked her where she got that idea, and she said she had talked to the judge, her lawyer, and her son's counselor in prison and they all told her this. I said i dont know about all that. Well she said i could just sneak and take her and you would never find out, but i wont do that to you.

I want to know if she can do this? The court order is supposed to specify that she cannot take my daughter out of state, but it doesnt.

Tell her if she takes the child out of state without your consent,you will file to have visitation rights terminated. Then Do it. Grandma can then try to explain why she defied court order, took the child out of state without consent in order to give visitation to a sex-offender. :cool:

If it is not stated in the CO, then it needs to be.
I'd definately file to include that your kiddo cannot be removed from the state nor visit the sex-offender.

I didn't see reference to a court order. I got the impression that this woman was just being nice to granny since granny has a granchild, despite raising the loser. OP- do you have any court order?

Can i file for a modification of the order just so that certain things are specified in the order that were supposed to be in the first place but arent?

I am glad he is not in NY state. It gives me the creeps really thinking about my daughter near him. But if he were in Ny could she really take her to visit him without my permission? He doesnt have any visitation rights that i know of. No court order. I mean, he in federal prison for exchanging child pornography of a sadistic nature.

I just get paranoid when it comes to my daughter, and want to always be able to protect her. And i dont think there is anything good that can come out of her being around him. He hurt me many times in the past, and i will not let it happen to her.

The last sentence refrences a CO, so I think there is one.

So there is an order giving granny visitation? If so, she can do anything she wants during her visitation (absent drugs, or crimes) if the order does not prohibit her from doing so. BTW that includes taking the child out of state if the order does not say she cannot do so.

Okay, you say that she has visitation. Do you ALLOW her this visitation, or is it in fact in court orders that she be able to see your daughter?!?
