if magistrate have a decision that the kids should be with defendent and the childeren is mother care mother is capable to care for kids how would she appeal

Need more information than this. Who is the defendant? Who are you to this case? Why was the mother found not capable of taking care of children?

And you can't just appeal the decision because you don't agree with it...there needs to have been an error of law.
