when can a child make up his/her mind on where to stay

I am the mom of an 11 year old daughter living in Maine. She would like to be able to make up her mind when she is to go with her biological father and when she doesn't but thus far it seems the legal system sides with him. My feeling is that she can go to his place when ever she wishes regardless fo the order but he feels that his rights are his rights and even if she cries the entire weekend or week, that she is to stay there. When do the courts listen to the child instead of the parents and their rights?We have had a counselor put in writing that she feels the decition should be up to my daughter but a guardian ad litium felt a year ago that we should give it a little more time. Any ideas? Is there any hope for this situation before my daughter goes off to college?
