    Ahh Geesh...here we go again

    What is the name of your state? Oregon/Arizona

    My husband has custody of his 2 daughters ages 12 & 13. Divorce and decree was done in Oregon and final in 2000. The past 4 years he was ordered to pay $5000.00 per month (half his income) to the ex for spousal support..she was to pay 800.00 per month for child support which was to come off as an offset....but there were arrearages so our support was then modified to 55% of the income of the household...Fast forward 4 years and the ex marries her atty...(yes, her atty.)

    The decree stated that in March of 2004 her spousal support was to go down to 1500.00 per month plus 20% towards arrearages...so it was modified that 1800 per month comes out of his check.... Since this has taken hold the ex has yet to pay any child support...NONE...zilch....

    The original decree stated that she was liable for 1/2 of all medical/dental that was not covered by insurance....

    Orthodontist bill for 2 girls 11550.00 (beautiful smiles ...priceless)
    She and her new hubby claim that since her income has dropped now to 1500.00 a month (she doesn't even mention it's 1800) that she doesn't have to pay anything because she is unemployed.....

    Now...They (ex and love lawyer) are claiming that since her income has dropped to this "1500.00" per month that their portion will only be 16% of this based on what they say the support calculator is for the state of Oregon....Okay great....but when I go to the support calculator on the "love lawyers" web page it makes me put in an amount of 1221.00 for her income because everyone can get a min. wage job....

    My question (geesh, didn't think I would ever get to ask it cuz I blabber on....) Is there a way to calculate the love lawyers income into all of this? They sure calculated my retirement in when we had to cash it in when my husband was out of a job...the Judge made me give her a handful of it....I do know that they share expenses on some of the household bills....he pays for this and that and such....

    How can she claim she is unemployed and broke when she is married to her atty. and they can afford Hawaiin vacation, cruises and all the luxeries...????

    I know, I know...the law isn't fair but dang...can I atleast write her back and tell her that she should base her income on the support AND a min. wage job?
    (Oh, she went to school for the last 4 years and didn't graduate and doesn't plan on getting a job)

    His income is moot, just as yours should be. If Dad isn't getting support, then he should take her back to court for contempt.

    And there's nothing unethical about marrying her own lawyer. Marrying Dad's lawyer - different story.
