What is the name of your state? OR
My disabled brother is having a heck of a time with his SS disability check. They take out 1/3 for cs. The 3 boys are over 19 and this has been going on for a year. The oldest son is 23 and moved here years ago and the 2nd to the oldest moved here over 5 years ago. His x was charged with claiming benefits in 2 to 3 different counties in NC. Each St. says they show that he doesn't owe and SS says they can't do anything but TAKE OT THE MONEY until a letter is written by the states. Each letter he gets says he owes the same amount. He's on a very limited income and can not afford to have this money taken out each month. What can he do? Please help anyone. Thank you:eek:  :(:cool:

This honestly sounds like a situation where he will need to retain an attorney to get anything done. If he is collecting disability, he should talk to the local bar association to see who might do pro-bono work and also talk to legal aid. If the order was recently issued, he should have a 30-day period in which he can appeal the decision and he SHOULD utilize that appeal process because once that window closes, it's too late .

He should write each County's in each State , Support units , requesting Letters they no longer have an interest in the case , and/or owe child support .

Send the Letters Certified RRR , by US postal Service .

If He receives letter to that effect by All CSEUs involved , then He should file a Child Support Modification in His State Jurisdiction , If one of those orders were made there , and take the letters with him , and also forward copies to SSA as they requested .

When and IF he gets a modification order that says he no longer owes child support , He should forward a Certified Copy by the Court , to SSA Office nearest him , Certified RRR.

Other wise as Stated , seek Free legal Help , or at least get a consult for a small fee .
