What is the name of your state (only U.S. law)? NY

The custodial parent has decided to file for child support after 4 years, but the child does not live with the custodial parent. Will the non custodial parent have to pay the same amount.::mad:

Then why didn't the other parent file for custody a long time ago? If one doesn't have custody, why isn't the other fighting to get their child home?

And, yes, both parents should be ordered to pay CS to the guardian.

The child lives with the great grandmother of the mother full time. On the child support petition the address of the mother is listed at the great grandmother's address which is not correct she lives in her own apartment.

The child is picked up and dropped off at the great grandmother's house.

Stupidity is the reason he never went for custody. Hoping she would eventually have the child with her. He also didn't pay child support because the child didn't live there.

So he was ordered to pay CS but did not and never took it to be modified because of addresses ?

Will CS be the same ?

Maybe,maybe not .

If you can prove your child resides and is being raised by the grandmother ,it might be lowered .

Arrears will NOT go away .
