I have not yet received this months support payment and am getting worried.
I spoke with x who says he mailed the check a few weeks ago however the
good folks at the child support office have said they haven't received a check.
They also said he has 31 days from the date it is due before it's considered late.
And they said before i could file contempt that he would need to be a certain
amount behind but they couldn't tell me how much?
Does anyone know how much behind he has to be before filing contempt?
He already owes me over $4000 in arrears that he's supposed to be $50/mo.

He is self employed so it's not garnished and he does pay directly (or is supposed to anyway)
THe $4500 he owes me are for arrears from the time of birth up until
the date that the child support was established.

Does the court order cover the time of birth till CS establishment?

then the $4500 is not considered to be arrears in the sense that he is not behind on those payments, only making payments on retroactive child support that you are owed. Of course, he is behind on the one payment. Have you tried contacting him, to see if a check has been sent, it is not unheard of that a payment is credited to the wrong account, or that a check is lost in the mail.

My husband sends his child support to CSE (its not garnished) and there have been a few times his ex calls bitching about "Where is my money???" and he'll have the cancelled check that was cashed a WEEK before (or more) but CSE just hasnt put it into the account yet that CP's can draw from. He's never been late on a payment but she's called at least 4-5 times.

So they may have his check & are in the process of cashing it/sending it to you...in fact if he says he sent it, its very likely its somewhere @ CSE.

If you dont get it in another week, try your ex again, and also CSE.

yes, the child support was ordered from the time she was born 12/04 and
we established child support 3/06 which was to go back to birth.

I spoke to him on the phone, he says he sent it in but have called and they have
not received a check yet.

How much does he have to get behind before I need to file for contempt?

Since you're so hell bent on filing contempt charges because you've asked this TWICE now, :rolleyes: there isn't a set "amount" as everyone pays a different amount of child support. If he hasn't paid several consecutive months, then you can file contempt. And the arrears issue was already explained to you, but you're not getting it. :rolleyes:

Then why are you TELLING us he owes an ARREARAGE. He owes back, or retroactive support. It is not the same.

Why are you getting so worked up over ONE payment that's not even late yet?!?!?

Let me guess, you DEPEND on the child support to pay the bills, right?
