Umm...the FACT IS that HE did not exercise HIS right. It is a COURT ORDER, not a suggestion. He is ordered to pay support just like she was ordered to have the child available for his parenting time as ordered by the court. If he continued to go and exercise his time and she denied him, then he would have had a case -- THEN. Not now.
So, the answer to your question is "no."
