child support


What is the name of your state (only U.S. law)? texas
hi my wife suffers from bipolar disorder and her daughter now 14 wanted to live with her dad so she agreed along with the courts. She has been unemployed since jan 09 and the court based child support on my income and i have been paying the support payments. But my income has gone down and i cant afford to make payments and she is not my child does this seem right?

Mom needs to file for a downward modification.

When was the order made?

I dont understand the question i dont beleive i ever thought she was mine i dont want to see my wife go to jail and i dont understand how a judge can go off my income if she is not mine

I'm thinking he's paying the CS on behalf of unemployed Mom...

Mom needs to get a job though - and OP, Mom will be hard-pressed to modify such a recent order so soon after it was made.

The judge apparently thought your wife was deliberately under- or unemployed; in that situation your income can be taken into consideration when determining the amount.

thats the problem mom has been trying to get a job its not that she doesnt want to work the job market is dead she is a family law paralegal and there is no openings for that or even admin jobs

beleive me she has even trid mcdonalds and our grocery stores are laying off peopple so we have and still are trying to do what ever it takes and thats
the thing is every one seems to think there is an option out there and reality is theres not
