Question

Child Support Agency Holding CP payments


What is the name of your state? TX

I'm the custodial parent and my child lives with me. The Noncustodial parent is responsible for making payments. . I opened up a case with the attorney generals office about 7yrs back and I was receiving my payments through them. The NCP decided that he wanted to sue for custody. We hired private attorneys and he was still required to make child support payments. The payment were either sent from his attorney to mine or sometimes he sent them directly to me. Also the payment weren't sent when they were due. The custody battle went on for about three years and I was finally granted once again primary residence for the child. I reopened my case with the attorney generals office and I served his employer with a wage garnishment. The attorney general saw that the NCP was in arrears during that three year period since funds wasn't being sent through them. I gave an account for payments made to me but when the numbers were tallied the NCP still owed a debt. I've been receiving my payments through the attorney general for about 8 months an all of a sudden my payments have stopped without notice. I was told different versions of why payments may have stopped an they don't make sense. I've been getting the run around! Can they do this?

So are you saying that the child was with dad for three years, you WERE receiving CS anyway to cover all that time, and now you are not getting it?

No The NCP never had my child for three years. He only had visitation rights and I was managing conservator. He fought for joint custody and then tried to fight for sole custody by making false allegations. A court appointed study was ordered to be done on both families due to his false allegations. My child was placed with my parents until the results of the study was conducted which took time because the psychologist wouldn't begin her study until she was paid first. This was in addition to lawyer fees an other expenses.
Also the NCP's attorney was able to get most of our court dates canceled due to the NCP not being able to show up. He was ordered to pay my parents child support since my child had to stay with them. Naturally I covered the cost of things when he didn't send payment to them or when they needing something for my child. Once the study was completed there were no findings for his lies. The NCP's lawyer fought to cancel out any judgements that could've been filed against him for those false allegations. We remained joint conservators and my child lived with me. That's when he started paying support to me once again but the arrears collected for about three years while he was ordered to pay my parents. I did give them my record of payments.

So the arrears accrued during the time that dad was court ordered to pay your parents, correct?

You mentioned that you gave them proof of payments made TO YOU, did you (or your parents) produce proof of any payments made TO YOUR PARENTS during those 3 years?

I gave the CSA proof of payments made to me. I decided later that I needed the CSA to keep track of the payments because he was sending them late. So all payments made to me before my case was reopened with them I gave an account for. My parents said they didn't record payments being made one because he wasn't consistent with making them and two nobody told them to kept track of payments he sent. Also when he did pay the payments were paid by money order and cashed at random places that allowed money orders to be cashed and they didn't keep receipts. They also said that he was the one ordered to make payments so he should have kept a record. My parents aren't favorable towards the NCP because he lied to the court and used my child as a way to get out of paying support. He fought a hard fight for sole custody in front of the court an now he barely contacts this child.
