Prior to our relationship my fiance briefly dated a young lady in 2002 they went their separate ways for whatever reasons.November 02 she informed him that she was 5-6 months pregnant he came home informed me of the matter and steped up.She advised him "there was nothing for him to do she can handle this".She refused to involve him in Dr's appt & etc..The child was born March 03 again he attempted to be involved and asked for a DNA test she agreed then reneged after he paid his half for the test, being told again "she didn't need him she got what she wanted fom him".He had not heard from her in over a year, all contact information he had for her was changed and she no longer resided at the last known address.She recently filed for child support after she saw us.He would like to emancipate himself and/or terminate his parental rights and child support,if he is proven to be the father after the court ordered DNA test he filed.How can we proceed with this? The mother is not in a financial bind she is a practicing attorney.

If he is proven to be the father, then his choices are pretty much to pay the ordered CS and have nothing to do with the child, pay the ordered CS and become an active part of the child's life via visitation, or pay the ordered CS and seek to become an integral part of the child's life via joint custody. Unless the bioMom is married and her spouse is willing to adopt the child, it is unlikely that Dad will be able to terminate his rights/responsibilities.

As a matter of fact if you have proof you paid 1/2 to begin with and she backed out, ask that she pay the entire cost of new testing .

Plus if you have that proof , even if the results are positive , you're credibility would tend to be believed .

Thank you to all that answered.He does not want to be apart of the child's life,however if he is proven to be the donor he will pay the support.I will certainly pull the file with the proof of payment and take that to our attorney.If by chance if anyone is enlighted with a new solution,laws,or similar cases that can be used please do not hesitate to forward it to us.
