    Contempt of Court HELP!!!!

    What is the name of your state (only U.S. law)? Texas

    My cousin is living on my couch after she was released from jail after serving time for failure to pay child support. Now her ex is filing for her to be held in contempt of court again for the same child support and he took out a temporary restraining order. Since she has been released she has borrowed money from my parents for her child support. We have helped her get a steady job and starting to get her life in order. I know she totally screwed up her life before by rarely paying any month than by making partial payments. Before she was served these papers she was trying to reconnect by getting help from domestic relations to clarify her divorce papers and enforce visitation. Any help will be appreciated.

    What kind of help do you want from us? She needs to support her children, we cannot help her do that; but you certainly can.

    Her ex is well within his rights.

    I am not paying her child support, I simply do not have the money. I gave her a place to stay and helped her get a job that is help. I am wondering if because she has already plead guilty of contempt of court for failure to pay child support isn't this double jeopardy?

    Given that she failed to pay--once she got out, she can certainly be on the hook for continued failure to pay child support. In addition, Dad can file contempt charges against her for any month she fails to make the court ordered suppport payment.

    If she is working, then she needs to contact CSED and see if getting a downward modification is a possiblity.

    She may also want to look into a second (or third) job.

    He is asking that she be held in contempt for past payments (before and while she went to jail). She has not missed payments since she got out and she has been making small arrearages. Does she need to contact the CSED before her court date about adjusting child support or let the judge handle it in court?

    Thank you for all your help. I do not have children at all so I know nothing about child support and I am totally lost. But she has nothing and I am family so I feel required to help. I have been doing a lot of research and know that she was in the wrong.

    If she is currently up to date with her payments since the last contempt AND following the payments for arrears plan, then she will not be found in contempt since she is following her new revised court order.
