CS deducted from pay. DCSE wants me to pay more cash.

Hi All,

I live in Virginia. I worked at a job that caused severe carpel tunnel. My entire arm would go numb and I could not drive my car. The pain was intense. My doctor told me not to use the arm and wrote me a plan for recovery. I sent a letter to DCSE informing them of my problem. In the meantime I found another job that I could work at with no problems.

I got 127.00 behind because of the time of recovery. I have always paid my child support. I did not receive any communications from DCSE during my time off from work, but as soon as I went back to work and continued my payments, even sending in extra money, I received a nasty letter telling me they were seeking imprisonment because I had gotten 30 days behind. This was sent after about 6 months of being back to work and paying CS. My CS was deducted from my paycheck and that should have caught me up completely, but DCSE has demanded that I come in and pay an additional 127.00 by this thursday in order not to be jail when I go to court because as they put it " it was deducted from your pay, but we won't receive it in time before court and if we have not stamped it received, you have not paid it." She also stated that because their office is closed this coming thurs for a holiday that it puts them a day behind.

I should just be able to go into court and show the judge my doctor's order, a copy of the letter I sent to DCSE informing them of why I could not work, show my paystub where my CS was deducted and not have to worry about going to jail, or having my DL suspended, but DCSE is telling me that the only way to prevent these things from happening is to pay extra.

any thoughts? I don't have an extra 127.00 to give them. Thanks.

If you don't have the $127.00, or paid it already you need to give all your documents and info to the Judge. It sounds like you have done everything that you can to pay, so I don't think the court can find you in contempt. (I am assuming that DCSE is taking you to court alleging you are in contempt.)
Somebody in that office has gone crazy, and about the only way to straighten it out is to give it to the Judge.

The thing with child support Enforcement , is they don't give a rats ass about you.
All they care about is procedure and Enforcement , and technically being correct .
Even supervisors at Child support Enforcement , have their butts up their behinds.

They will file a contempt , you can count on it , if you don't pay.

Show up in court with your proof , it has been paid .
 
Don't pay anything additional (not an option anyhow, right?)

If you cannot access it online, you may want to go into the CSE office and receive a printed copy of your payment history. This may help as it would only show one (?) missed payment and your paystub would reflect the balance being paid.

CSE, like any other debt collection agency, really isn't interested if you were injured or blew all of your money at the casino...they just want to collect the debt. The judge would be a different story...have ALL of you documentation if you have to appear.
