CS and Social Security


What is the name of your state? New York
My wife actually pays child support. She was in a relationship with a drug addicted abusive man. She ended up in a womam's shelter and the twins ended at his mother's house as she had no support what so ever. So he took her for cs to get money. (2001) FYI he made up an address for her for the court, so the papers she was served with had incorrect information. He walked out of a custody hearing because he found out thats not "where he gets the money". At the time of their relationship she was the only bread winner.

Flash forward to 2005: She has a disease that causes her lung to continually callapse. 8 chest tubes and 2 surgeries later she is disabled and living with me in FL. The twins are on the way to college.

After being out of work for periods and failed apps for downward modification she is informed not by cseu but by her job that 65% of her pt job she works to help make ends meet is going to arrears. she began breaking down. 4 days ago she received a letter for social security (again not from the cseu) that of her 1380 in ss benefits cs is now taking 900. leaving her roughly 400 a month to live on. When she called ny cseu someone got nasty with her and decided he would leave her pt job alone and take her entire ss check. basically forcing her to work. which if she contiues she will lose ss benefits. (after 9 mo of continuous work)
One twin has been kicked out of school because he has forged student loans in both their names and stolen the money. The other forced to drop to pt.

Why is NY so uncooperative to the only parent doing anything for the girls. how does she turn things around now being 22,000 in arrears? and what can be done so her entire ss check is not snatched?

Despite being long this is not everything of course. She suffered more humiliation during this and is now having a complete breakdown. she is barely a functioning person from the abuse by him and the system. We need help.What is the name of your state?

I don't know why her CS wasn't modified when she became disabled .

Why did the attempts fail ?

At any rate CS arrears will not go away , especially if the State was providing support for the children .

She would have been better off not arguing with CSEU .

I'm not sure if her SSDI can be garnished for the entire amount .

If she is disabled she could have future obligation modified .

She may want to contact SSA .

Also , at the time , she could have taken the children when she left the abuse .

Suffolk Cty Court


She sent in the forms to Suffolk cty and they told her they would grant her a telephone hear for the modification.
They never granted the hearing.

I don't know why her CS wasn't modified when she became disabled .

She was told be a lawyer today it might be possible to have the arrears during the period of disability removed but it was hard to do. And judging from what i've read about arrears it probably won't happen.
They guy in the cs and disability post should be glad because in ny it $3500 minimum for a lawyer.
At no time was the state providing for the children. Welfare in no shape or form was ever involved.
Not only did she pay for years but bought their school clothes among other things.
Because the magistrate refused to reduce her order years ago she was forced to work overtime for years.
I don't see how this strong arming is legal or in the best interest of the children.



From my experience CS is nasty to everyone they deal with as I was once in arrears myself and now find myself back there because of their error. (i'm a reservist- told them stop taking from my reserve check and my state job because it was causing overpayment. only take from my state job. they did the opposite and since reserve pay is not enough to cover cs i am now $250 in the hole.)
but that is nothing compared to what she is going through.

I will have her contact SSA because she has a ton of Dr appointments we can't pay for. ( Iwould attack SSA and medicare but this is not the forum for it. but just so you know they don't grant med benies till 2 yrs after they grant disability. gov't and legislature, go figure.)

And she has been regretting that since it happened.
I wasn't around then but I can tell she was bullied then too. That's been her life unfortunately. Its a shame because she does so much for other people. especially her kids.

Did she ever receive any documented letters about tel. hearing , or in person hearing ?

They didn't send her any notice. And we just found out last night that he has listed a new address with child support so that he can ask the court for more money
