custodial parent and new spouse's income

What is the name of your state? Pennsylvania


Hi, my husband was just summoned to court for child support. Until now, both him and the custodial parent has a mutual agreement that all expenses would be split in half, which he has been paying. My question is, the custodial parent remarried a few years ago and her spouse makes over 7 times what my husband makes. She is a homemaker. Will her spouses income count when determining child support? Thanks!

No, her spouse's income will not count. However, he can ask the court to impute an income for mom based on what she could be earning.
