What is the name of your state (only U.S. law)? Ohio

My ex gets social security disability.

Child support was terminated prior to his approval, so there is not an active case.

My child has been receiving the dependant benefits since his approval.

Can I sue for child support and ask that he reimburse me 50/50 for medical expenses?

You can ask, but Dad will likely request that the dependent benefits be considered in lieu of child support.

What are you hoping to accomplish?

The court won't make him destitute.

I've had 1500 worth of out of pocket expenses this year.Not including the monthly benefit amount. It's kinda making me destitute to do it on my own.
Shouldn't he have to help with medical expenses?

Not until he's ordered to do so.

The court might order him to pay half, and if you're really lucky you might get that retro to cover your current expenses. I wouldn't count on it though.

Why was the original order terminated?

He applied to have it reduced. And then told the child support office that he was applying for disability. So it was terminated.

Let me clarify...

I know that the dependant benefits are in place of child support.
When I said sue for child support, I should have wrote reopen the case.
I just want him to be responsible for half of the out of pocket expenses.
Does that seem likely?
I guess I am just frustrated that he incurs no expenses for having a child!

Write your legislatures .

Laws were set up the way they are by them .

Why not look into x-tra ins. avail. through the State ,if any .

Presumably you are the able bodied parent who is capable of obtaining an earned income, and he is not. You may wish to up your contributions to any Flex Plan pretax savings account to which you may have access.

It really wouldn't take all that much, these days...sigh.

I had a client ask me today for my opinion on his options at his new job as far as medical insurance was concerned. 700.00 a month for a family plan, with 250.00 deductible for each person, or 350.00 a month, HSA option, with a 1000.00 deductible per person.

Those figures alone tell you what "ordinary" medical costs could be. Think about it? If an insurance company is willing to cut their premium in half in order to raise a deductible 750.00 a year per person, then "average" medical costs are a lot higher than most people realize.
