EmancipationWhat is the name of your state? N.J. I understand NJ has some of the toughest laws regarding child support and emancipation and each case is different however my question is this. I have been paying CS since since 1998 when my daughter was 9, she is now going to be turning 19 but I have no clause of emancipation in my divorce decree, The ex has physical custody and because of her failure to monitor (or care) about my daughter school work she failed to graduate high school in 2007. Although I'm in NJ I do not live in the same part of the state as the ex and have a hard time gaining info (report cards, homework ect ect), I have just been informed that because of my daughters truancy record ( for which the ex was summoned to court for) she most likely will not graduate in 2008 either. Being she is turning 19, under these circumstances is it possible to have her emancipated ? I have heard thru a reliable source the ex isn't very concerned because if she keeps failing the CS check keeps coming. nice right |

| How accurate this info . is I do not know personally , but here's some reading . Your theory that the child is failing because of the mother's alleged lack of parenting won't fly . The child would also have to be fully self supporting to be emancipated .

Thank Youshould my daughter decide to quit school and began working full time would that be considered fully self supporting? again thank you and I understand this is merely an opinion. |
