What is the name of your state (only U.S. law)? Florida,
2 months ago, my fiancee of a yr lost his job of 12yrs. He has a child from a previous relationship in which he pays child support for. U.C. will automatically draw 40% from the benefits which is standard procedure. So he took his court order to CSE to show them he was paying too much, and they made the appropriate adjustments. I just want to point out that he has made no motions to reduce the amount he pays..considering it was based on a job he no longer has.
Now, though text msg, she has relayed that she was going to basically retaliate by accusing us of drug abuse. She believes if she can retain full custody of the child, she will be awarded more support, and she can go back to receiving 40% of his income. She only follows the court order when it suits her, she withheld visitation, she withholds visitation for the paternal grandmother, she denies him the right to use his mother as his agent when it comes to transportation, She won't discuss things like placing a 4 yr-old on a highly addictive narcotic(adderall)with his father, but she'll call to inform him that she changing his school.
She did follow though with her threat. We had a CPS agent show up, and request a drug test.
I said no. Under no circumstances will I give up my 4th amendment right based on hearsay. Nor am I going to allow her to subject myself to her tyranny. I have no legal right to the child in question, and wish to remain out of the ugly custody disputes that has arisen. My fiancee has taken the same stance as I have. He has stated that until there is a court order he will not comply. Does her behavior constitute extortion? Can you advise me on my position?
