What is the name of your state? Az

Dad wants to get an extra job so that he can set some money aside for his oldest that will be starting college soon. If he gets that job can the mom then take that income and add it towards child support (mom 2)? Does he legally have to inform her of this? He alread has paid roughly 5k to the school and just wants to make sure that he can stil be able to help her out.

there is a second child right?
Unfortunately, ANY income is subject to the child support calculations. And, although he is not required by statute to inform her, if she files for a modification of support he will have to report such to the court.

There are 2 kids from 2 different moms. If he quits b4 the modification would the court still assign it? Basically I guess this job will be through a relative of his (accountant) and he will just be doing work on the side and the guy is gonna pay him 3k a month for it. He doesn't wannt be sneeky or anything and work under the table and this income is solely for the oldests college.

Actually, ANY income is for the support of BOTH children. and since the children have separate mothers, there are two separate support orders. Which means that unless he is required by the initial order to support the child through college, his making deposits into such an account is voluntary and can be used as income for the purposes of modifying the second child's support.

The fact is, he needs to sit down with your state's support calculator and figure out how the second job will affect his support payments to the remaining child.

That's what I was thinking too. No he isn't court ordered to pay for college, he is doing it because mom wasted all of the money that dad put into savings for the daughters college (when they were married) on booze and he cares that his daughter at least has a chance. I'll tell him to sit down and try to figure it out. I think it might be better for him to get a loan and pay that off then do it the way that he wants to. Probably save him money in the long run.
