Federal crime to not pay child support

The Child Support Recovery Act of 1992 makes it a Federal crime to willfully fail to pay support for a child living in another State.:eek:

If this law is so true then how does a NCP hide from CSE for 5 yrs. to avoid being served cs papers then is finally caught and court ordered to pay support. NCP goes another 5 yrs. of not paying cs. NCP then tells CSE that child does not live with CP. CP proves NCP is lying to avoid paying support. Then NCP goes on welfare while living at home with parents to avoid paying cs, finally NCP started paying support then stops this goes off and on for a year. Court did not order support for the first 5 yrs. that NCP hid from them, so NCP gets away scott free. NCP owes $18,000.00+ in arrearages now.

How do you get a cs case moved to federal court??????

I am not sure it's a federal crime from the get-go. It's a CRIMINAL crime to willfully not pay.

It becomes a felony if an arrearage hits 5k. It's usually up to the Judge how to handle that, depending on the circumstance. If someone hasn't been paying for a long, long time and has been hiding to avoid paying, a court could very well order the obligor to pay a purge or go to jail.

Many times an amount is added to the current support obligation to pay back the arrearage. I believe there is a federal law (if not, state) that allows only a certain percentage to be added to current support.

You don't. They have bigger fish to fry.

The arrearage will never go away. Unless it is forgiven or the state is seeking back support (medicaid, etc).
