...Yet do not and have not established legal custody of the child. We were informed by a hearing officer in Child Support Enforcement court today that it does not matter if the maternal grandparents had or ever established legal custody, that mere possession of the child warrants the right to petition the maternal mother for child support.
We consulted an attorney before today's hearing (however did not retain them), who stated the contrary. That in Florida, legal custody must be established first. I'm confused. Which is which? Is Florida a state that does not distinguish between physical and legal custody or were we denied the opportunity to proove to the hearing officer the Maternal Grandparents never had custody? Important to note that the child now resides with us again and today's hearing was to abate ongoing, but wife is still responsible for retro.
