    he's full of it right?

    What is the name of your state (only U.S. law)? NC
    NCP is finally paying CS. Recently he starts demanding that I provide recepts for where the CS money goes to. I told him that wasn't up t him to demand and that I was not itemizing and saving evey single stupid receipt just because he thinks he's entitled to see where I spend MINE and the KIDS' money!

    Now he's filed contempt charges for child support????? No explanation on the papers it just says a "show cause order for Child Support Payments" When I called and asked him what that was for he said "I hope you have all your receipts ."

    He pays the support how can he make it look as if I pay to get a show caus order in an attempt t make me show him where the cs goes? When it was ordered he attempted to have the judge order me to show receipts every month and the judge told him no.


    What is going to happen in court? And could he find a sympathetic judge?
    I always thought that what I do with it was my business? I mean please my bills are almost $3000 a month and his payments are all of $421.

    Oh, silly silly Dad. I don't think he's going to get very far with this in a courtroom provided the kids are cared for appropriately.

    What I would pay to be a fly on the wall in that judge's court room! OMG - I thought I've heard it all.

    Does your court order state that you must provide receipts? I'm sure it doesn't. Therefore, you are NOT in contempt of court - it would have to be in the court order.

    Child support is a reimbursement from the NCP to the CP to help cover the costs of raising the children. You do NOT have to do an accounting.

    I know what I would do, but, I don't suggest poking bears.

    I thought so, but if I did have to, I just bought new beds for the kids and a new car since my 20 yo car was DOA at the mechanic. That's what he is so upset about. And is always complaining that "I'm putting him in the streets, while I live like a stuck up queen". Mind you there's a few explicits in that statement.

    See, I would be the type to bring in ALL my receipts and my neighbor's receipts, etc. and say, take your pick! Which receipts do you want? I have all sorts of receipts here.

    Be sure to keep track of your expenses for the hearing. You should ask to be reimbursed for your transportation costs, parking, legal expenses (if any) and so on since it's clearly frivolous.

    If he's paying considerably less than he should be, you could consider a motion for more money. That would teach him.....

    Under what he was making when I filed it should have been over $600, but he got a 2 month continuance and from the time he was served till then they cut his hours and his supervisor so sweetly gave him a letter that it wasn't voluntary. Funny a few weeks later he was working 40+ again

    If he's paying considerably less than he should be, you could consider a motion for more money. That would teach him.....
    I wish I could, but NC has a 3 year wait for modification, the way I understand is 3 years AND a 15% change. Also it's not garnished so he only pays what was ordered for current and refuses to pay on the arrears!

    If he has been ordered to pay arrears, then file a counter show cause hearing for HIS lack of payment on the arrears. If he is paying you directly, then provide a summary of payments; if he is paying to the courts, then request an accounting as proof of his disregard of a court order.
    No whining allowed.

    Ahhh! I forgot I could do that! ty ty ty ty ty ty! He pays me directly and I make copies of every check! Could I then also ask for it to be garnished since he's disregarding it?

    You got it honey! THAT is the proof that HE is disregarding the court order.

    You do NOT have to provide receipts because you are not COURT ORDERED to do so. If a judge said, do it, then, you go, "Yes, Your Honor" and make those copies. A judge is NOT going to order that.

    I assume that your children are fed and clothed and they have a roof over their heads with the utilities turned on, right?

    Bring in a full accounting of what has been paid and make sure that you have copies for the judge and for your X. You can get copies made cheaply at UPS and office places.

    Make sure that you figure out all the costs of him taking you to court and ask that he repay you for your expenses. Don't necessarily expect it to happen, but, you never know.

    As part of the remedies, you seek garnishment of wages.
    No whining allowed.
