Imputing Income

A Friend of the Court (FOC)review was done to determine if there were to be modifications to child support orders. Defendant (dad) didn't produce any documentation to determine income. FOC imputed the Defendant's income on last known quarterly wages (2003). Defendant Objects to the recommendation based on self-employed business had failed and new business (the exact same type-landscaping) had just started therefore no business records (quarterly records) were yet available.

THe problem: Imputed is based on known facts. Defendant's prior work history. Defendant has had 7 such said business ventures in the past 10 years. All have been failures. Defendant does not file income , wage, or other tax reports. Plaintiff would like court to order support at imputed amount. What is the likelihood that the imputed income amount will be ordered?
